If you tell him honestly what you feel about it, I think you're fine. It will definitely work out if both parties really like each other. If he's prepared to wait for you, he will :)

My husband is 5 years older than I am. However, to be on the safe side so neither of you get into trouble, check the state laws where you live. In my state, if you are under 18 years old and the other person is 3 or more years older, they can be charged with a crime such as statutory rape. If convicted, they would have to register as a sex offender for the rest of his/her life.

It's totally fine. what's not allowed is sex, he can get in jail if you guys do anything sexual because that's considered child pornography. I totally feel you, the guy I'm talking to is like 4 years older than me and I'm 17.

I just don't want to be a problem for him..

as long as you are over the age of 18, you are okay to date him.

I'm pretty sure just sex is not permitted if you're underage. But other than that, go right ahead! If you both love each other, then there's nothing wrong with it. My parents are 7 years apart! (:

I second the advices given. Being in a relationship with someone who is 5 years older is not wrong (assuming you both sincerely like one another). However if you are below 18, I would ask you put a hold on your sexual activities til you are above 18. Other than that, I see no wrong in dating someone who is 5 years older. :)
